Wheat Ridge Annulment Attorney | Getting an Annulment is Not Easy

woman-1006102_640.jpgGetting an annulment or declaring the invalidity of marriage, as it is known in Wheat Ridge and Jefferson County, is not a simple process. Many people think that filing for an annulment is an easy way to end a marriage, but usually, that is not the case. There is not much difference between a Colorado divorce and an annulment, other than the fact that with an annulment, it's legally like the marriage never happened.

Lakewood Divorce Lawyer: Declaration of Invalidity of Marriage in Jefferson County

Very specific factors must be in place in order for an annulment to be granted. For a dissolution of marriage, claims that the marriage is broken is enough. With a declaration of invalidity of marriage, one of the following scenarios must apply according to C.R.S. 14-10-111 (1) - Declaration of Invalidity:

"(a) A party lacked capacity to consent to the marriage, either because of mental incapacity or infirmity or because of the influence of alcohol or drugs.

(b) A party lacked the physical capacity to consummate the marriage by sexual intercourse, and the other party did not know of the incapacity before the marriage.

(c) A party was under the age as provided by law and did not have the consent of his parents or guardian or judicial approval as provided by law.

(d) One party entered into the marriage in reliance upon a fraudulent act or representation of the other party, which fraudulent act or representation goes to the essence of the marriage. (claim of illness, marrying for a green card, or marrying for financial gain)

(e) One or both parties entered into the marriage under duress exercised by the other party or a third party, whether or not such other party knew of such exercise of duress.

(f) One or both parties entered into the marriage as a jest or dare.

(g) The marriage is prohibited by law, due to: bigamy or polygamy; incest (half or whole blood descendant - brother/sister or uncle/niece); or marriage which was void by the law of the place where such marriage was contracted."
