Mediation is a settlement negotiation meeting with a neutral third party (the mediator). If you settle on any or all the issues in your legal matter, the agreement is put in writing and signed by all. If you do not settle, you will have go to court and have it decide. The mediator can assist you in identifying all the important issues and can help in structuring a settlement agreement. Mediation is an excellent way to try to resolve a dispute and save you money.
Arbitration is an alternative to going to court. The arbitrator acts as a judge, hears testimony, reviews your documents, and then issues a binding decision. This decision can be filed with the court and becomes a court order. The risks to arbitration are that the arbitrator does not have to follow the law and you cannot appeal the arbitrator's decision. The benefits are that most arbitrators are fair, competent and qualified, and ultimately make good decisions. Arbitration may cost significantly less than going to a traditional trial with the court or a jury.
Mediation can be used in all disputes, such as:
Divorce and Family Law - many courts require one mediation session before they will let you proceed
Civil Litigation – if you are involved in a dispute, mediation may be a very good way to resolve the case
Business Dispute – before filing a lawsuit, consider going to mediation
Real Estate Disputes – the standard real estate contract used in Colorado requires mediation before you can proceed to litigation.
All other Disputes – ANY and ALL other disputes may be mediated.
