No one can blame a parent for wanting their children, but sometimes things can go too far and mistakes can easily be made. Below is a list of common mistakes that are made when child custody is at stake.

Common Mistakes Related to Fighting for Child Custody

While you, your ex, and the court are all considering what is in the best interest for the child, that doesn't mean that everyone will agree on what that is. When you feel like there is a possibility you won't get the time or custody that you want, it's easy to make desperate moves. Some of those common mistakes include:

  • Threatening your ex regarding child custody - Don't make statements to your ex about keeping your kids away from them. These statements will not be seen favorably in the Jefferson County Court as they will question whether you truly have the children's best interest at heart.
  • Making false allegations against your ex - In desperation, you may claim that your ex has a history of substance abuse, domestic violence, child abuse or any other type of abusive behavior. This is NEVER advisable and may actually work negatively for you.
  • Being careless with your behavior - If you are in the middle of a child custody dispute, you should not be participating in any activities that may be seen as questionable. You are being watched and everything you do is subject to disclosure with the court. Avoid alcohol and do not get into physical or verbal arguments with your ex.
  • Moving out of the family home - Now, I'm not saying you have to live with your ex the entire time your divorce is pending, but you should have something in writing regarding parenting time and visitation before leaving the house. This way you are guaranteed some time and not kept from your kids pending a court order.
